Terms and Conditions
1. Definitions
"Portal" - the website, application, dashboards, and related services operated by Evexia Analytics Solutions Private Limited.
"User" - any person who accesses the Portal, including school administrators, teachers, counselors, parents/guardians, and, where applicable, students.
"Student Data" - any information relating to an identifiable student, including well-being indicators, survey responses, behavioral observations, and academic performance data.
"Indicators" - the leading indicators tracked by the Portal (see Section 4).
2. Eligibility and Accounts
2.1 The Portal is intended for use by schools, educators, counselors, and parents/guardians acting on behalf of students. Students under the age of digital consent in their jurisdiction may only access the Portal through an account created and supervised by a parent, guardian, or authorized school staff member.
2.2 Account holders must provide accurate registration information and are responsible for maintaining the confidentiality of login credentials.
2.3 Schools or districts registering multiple student accounts represent that they have obtained all necessary parental/guardian consents required by applicable law prior to enrollment.
3. Description of Service
The Portal collects, analyzes, and reports on indicators associated with student emotional well-being and academic outcomes, which may include:
- Attendance and engagement patterns
- Self-reported mood, stress, or sentiment surveys
- Peer and social interaction indicators
- Sleep, activity, or lifestyle self-reports (where voluntarily provided)
- Academic performance trends (grades, assignment completion, test scores)
- Teacher/counselor observational notes
- The Portal presents this information through dashboards, alerts, and reports intended to help educators and families identify students who may benefit from additional support.
4. Not a Medical or Diagnostic Service
4.1 The Portal is an informational and administrative tool. It does not provide medical, psychological, psychiatric, or diagnostic services, and Indicators generated by the Portal are not a diagnosis of any mental health condition.
4.2 The Portal is not a substitute for professional evaluation, counseling, or treatment. Users who have concerns about a student's immediate safety or well-being should contact a qualified professional, school counselor, or emergency services without delay.
4.3 Evexia Analytics Solutions Private Limited disclaims responsibility for decisions made solely on the basis of Portal outputs without independent professional judgment.
5. Data Privacy and Protection of Student Information
5.1 Student Data is sensitive and will be handled in accordance with our Privacy Policy and applicable law, which may include laws such as FERPA/COPPA/GDPR for DPDP Act, IT Rules 2011 (sensitive personal data), POCSO, Juvenile Justice Act, and a placeholder for board/regulator (CBSE, state board, UGC) and children's-privacy regulations.
5.2 Student Data will be used only for the purposes of (a) generating well-being and academic indicators, (b) supporting school and parental decision-making, and (c) improving the Portal's functionality, unless a User provides explicit additional consent.
5.3 Evexia Analytics Solutions Private Limited will not sell Student Data to third parties.
5.4 Parents/guardians and, where age-appropriate, students may request access to, correction of, or deletion of Student Data, subject to applicable law and the school's record-retention obligations.
5.5 Schools remain responsible for ensuring their use of the Portal complies with their own data-governance and consent obligations to families.
6. Mandatory Reporting and Safeguarding
If information entered into or generated by the Portal indicates a risk of harm to a student or others (including suicidal ideation, self-harm, or abuse), designated school staff are responsible for following their institution's mandatory reporting and safeguarding procedures. The Portal is a support tool and does not replace these obligations.
7. Acceptable Use
Users agree not to:
- Use the Portal to harass, stigmatize, or discriminate against any student based on Indicators or reports;
- Share login credentials or Student Data with unauthorized individuals;
- Attempt to reverse-engineer, scrape, or interfere with the Portal's systems;
- Use aggregated or individual data for purposes unrelated to student support without consent.
8. Intellectual Property
All content, methodology, algorithms, and materials on the Portal, excluding Student Data and User-submitted content, remain the property of Evexia Analytics Solutions Private Limited and may not be reproduced without permission.
9. Limitation of Liability
To the extent permitted by law, Evexia Analytics Solutions Private Limited is not liable for indirect, incidental, or consequential damages arising from use of the Portal, including reliance on Indicators for decisions affecting a student, except where such liability cannot be excluded by law (e.g., in cases of gross negligence or willful misconduct).
10. Termination
Evexia Analytics Solutions Private Limited may suspend or terminate access to the Portal for violation of these Terms, misuse of Student Data, or as required by law. Users may request account deactivation and data deletion subject to Section 5.4.
11. Changes to These Terms
These Terms may be updated periodically. Material changes will be communicated to registered Users, and continued use of the Portal after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of India and under the Jurisdiction of Madras High Court, without regard to conflict-of-law principles.
